The standard Jobder User Agreement applies to this transaction. In addition, this is a binding contract between you and Jobder that governs this listing transaction.
It is important that you read, understand, and agree to this entire document, as it defines and limits your rights and responsibilities in using Jobder Jobs.
Posting:
You are posting for either yourself or your current employers, or if you are a professional recruiter or human resources manager, as an agent of another hiring manager. Use of any automated agents (“bots”) or scripts to post or modify job posts, check the status of job posts, or download resumes is prohibited without Jobder’s express written permission. You may not resell or transfer access to Jobder Jobs to any other party. Your account is for your express use only and not transferable to anyone else inside or outside your organization unless you have a current Jobder Jobs Subscription Agreement, in which case your account terms will be determined by it.
Editing and Renewal:
You may edit or remove your posting at any time. To change the title or company of the post, you will need to contact Jobder Customer Service. You may renew your job posting at any time; this will both update the date of the posting to the date of renewal as well as extend the posting so that it expires 30 days from the date of renewal.
Guarantee:
If within five days after your posting expires, you are unsatisfied with the response to your Jobder Jobs Posting, Jobder will, upon request, renew your job listing for one additional 30 day period.
Ownership:
The contents of the site, including your posting and any responses, are property of Jobder. You are granting Jobder a non-exclusive, royalty-free, perpetual, and irrevocable right to use, reproduce, and distribute any content you create, including your job post. You are also, by posting, granting Jobder a non-exclusive, royalty-free, perpetual, and irrevocable right to use, reproduce, and communicate the name and trademark of your organization as a poster of job opportunities on Jobder.com unless requested otherwise to Jobder Customer Service.
Liability and Indemnity:
Under no circumstances will Jobder be liable to you for any amount exceeding the amount you paid Jobder to post. Jobder does not guarantee the results or distribution of any posting in any manner. Jobder will not be liable for any damages under any circumstances that result from any posting or application via Jobder Jobs, whether to you or any job applicants. Jobder will specifically not be liable for any damages due to disruption of business, incidental, special, punitive, or due to loss of data.
Jobder Jobs functions as a “venue” and, as a result, cannot guarantee or protect you. Jobder does not screen or attempt to verify the accuracy of any information on the Jobder.com site or in the candidates’ applications, including recommendations, connections, or references. You are responsible for conducting due diligence on any and all candidates. As the operator of a public website, Jobder cannot be liable for any content created by someone other than Jobder whatsoever, including slander or misrepresentation. Jobder will cooperate with all legal authorities as required by law. Due to the nature of Jobder.com, you will be dealing with individuals, and Jobder is unable to warrant the veracity of any information on its site; by posting a job, you are releasing Jobder and its affiliates, employees, and shareholders from any and all liability that arises between you and any candidates that apply through Jobder Jobs. Jobder does not verify applicants’ identities, and you should exercise normal prudence and caution when dealing with candidates. Jobder is not, in any job posting on Jobder Jobs, the employer and cannot be liable for any hiring or employment decisions made.
You are, by posting, also releasing Jobder and its affiliates from any claim, including reasonable attorney and court costs, and taking sole responsibility for any such claim made by any applicant or other third party due to your posting or subsequent interaction with an applicant or third party.
Viruses:
Jobder does not screen candidate resumes and cover letters for viruses or Trojan horses, and as a result, cannot be liable for any sent by candidates. You are encouraged to use virus protection software.
Illegal postings:
You agree not to use Jobder Jobs to create an advertisement or advertise a position that that would be a violation of the law in your state or country, the state or country where the job is to be performed, or the state of California. This includes, but is not limited to:
Candidate confidentiality:
Candidates’ applications and resumes are confidential to the company they applied to (and any designated agent, for the purposes of the single hiring transaction). It is strictly prohibited to provide identifiable candidate resume or application data to any other parties or to contact the candidate for purposes other hiring transactions.
Posting jobs without a reasonable and legitimate intent to hire for the specific position listed is prohibited.
Postings that intentionally misrepresent the job, hiring company, or poster are prohibited. Failing to clearly disclose in the posting that a position is for an independent contractor or is part-time, piecework, commission-based, or has otherwise nontraditional working conditions or compensation may constitute intentional misrepresentation.
Jobder may, at its option, specifically remove any postings for any “business opportunities” that require payments or recruitments of others or that resemble franchises, multi-level marketing, club memberships, distributorships, or are entirely or almost entirely commission-based. The intent of this clause is to allow Jobder the flexibility to remove positions that are not bona fide job opportunities.
One opportunity per post: Each posting is for one (1) job opportunity; it is not permitted for one posting to solicit applications for more than one position.
Payment:
Unless you have a Jobder Jobs Subscription Agreement, each job posting is payable to Jobder using an American Express, MasterCard, Visa, or Discover card.
Termination:
All job listings will expire 11 days after the date of listing. Jobder reserves the right to remove any listing at any time, with or without cause. If Jobder removes the listing with cause (due to a violation of Jobder.com’s Terms of Use, this Jobder Jobs Posting Agreement, or any other supplemental governing contract), you will not receive a refund. If Jobder chooses to remove a listing without cause, you will receive a refund, prorated by the number of days (of 30) that the listing ran. In addition, if the terms of use are violated, Jobder may, at its sole discretion, suspend or remove your account.
Harassment:
It is prohibited to harass, stalk, or contact any applicant after they have asked not to be contacted. It is prohibited to “spam” or otherwise contact applicants for purposes other than related to the specific employment opportunity described in the listing.
Jurisdiction:
By listing, you consent for any civil lawsuits or other disputes to be settled in the district of Jobder’s corporate headquarters (Santa Clara County, California).
